By using BKS Training and all items therein involved, you automatically agree to the terms and conditions set out bellow
1/ ADMISSION
To guarantee places on one of our (BKS Training) courses, the course fees need to be paid in full, or pre-arranged amount before the course date
Places maybe reserved without paying in advance, but a premium price is due on the first day of training. However this is not a guaranteed place(s) on the course, and maybe turned away if course is already full or through the limitations of the study environment. Infrequent as this is, BKS Training does try and resolve all matters in this manner suitably.
Where discounted prices are offered, these are subject to full or partial payment before the course date.
Payment can be made by Cheque (Must Clear Prior to course), Bank Transfer or via PayPal on the Website booking page
BKS Training reserves the right to change the prices of its services without notice; however we will attempt to inform learners at the nearest possible opportunity. Delegates booked onto a course and paid part or full in advance will pay the less of the two prices
If training venue or other a like items change, BKS Training will attempt to inform learners at the nearest possible opportunity.
It is a Security Industry Authority (SIA) requirement that the trainer conducts an English assessment of the learner(s) before the start of the course. For non-SIA courses, an English assessment will also be conducted. Failure to comply or to reach an acceptable standard will be refusal from course.
2/cancellations and rescheduling
If a course participant is unable to attend and has paid either full or part fees in advance then they are responsible for contacting BKS Training via phone or Email more than 5 Working Days before course date. BKS Training will agree upon the nearest suitable rescheduling available within the next 6 months
If the course was organised by a Company for private training, it is up to the Company to inform BKS Training of any cancellation no less than 5 Working Days in advance. BKS Training will agree on the next suitable date to re-schedule training within the next 6 month
BKS Training does not charge for re-scheduling If we have been Notified within this time frame.
3/ Refunds
Participants are entitled to a full refund of paid monies, less administration costs if they inform BKS Training they are unable to attend the Course 5 Working Days or more before the course start.
Less than 5 Working Days no refund will be given as we would be unlikely to resell the course seat.
If a course Date is changed during the course due to Insufficient Documentation then 50% Of the course fee will be charged.
In the Event of Non attendance with no notification or Cancellation on the course date there will be no refund Given, In this instance the student would need to re book the course and Pay again in full.
In the event of non-attendance or Cancellation on the day where payment has not been made by the student, The full course fee will become due and payable.
If the course was organised by a Company for private training, and a cancellation takes place with less than 5 working days notice down to conditions outside of BKS Training 50% of the pre-agreed price will be refunded. If no pre-agreed fee was arranged, the fees of 6 learners or 50% (whichever the greater) of fees will be kept by BKS Training.
Alternative course dates can always be arranged as per section 2
BKS Training complies with Consumer Protection (Distance Selling) Regulations 2000.
4/ CHANGE OF COURSE
In the unlikely event that BKS Training has to change or make amendments to the course, BKS Training will contact the learners, and (in the case of private training) the company responsible for organising training, as soon as reasonable possible.
The choices that will be available are;
Accepting the new conditions
Cancelling and receiving a full refund of monies paid
Purchasing a different course from BKS Training and receive a refund or pay the difference if applicable.
5/ Delay or failure to perform on our part
BKS Training is not liable to any delay or failure to provide/perform beyond our reasonable control, which includes (but not limited to)
Act of God
War or civil disturbance
Governmental/third party intervention, act or omission
Industrial action or stoppages of work
Failure by yourself to notify BKS Training or provide BKS Training with suitable information including correct ad
6/ OUR PROMISE
We shall ensure that all services you order from us are in accordance with these terms and conditions and shall be performed by us with all reasonable skill, care and utmost professionalism.
Where an element of the course is not provided as advertised in the course instructions, you must notify BKS Training within 28 days of the situation in question. An investigation by BKS Training will be conducted and if found that discrepancies are apparent you shall be entitled to;
A full refund of the course, or the section of said course (if appropriate)
A free course to the equivalent value of the course where discrepancies were found
BKS Training will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the contract for:
5.3.1. Any losses which are not foreseeable by both you and us when the Contract is formed arising in connection with the supply of the services or their use by you;
5.3.2. Any losses which are not caused by any breach by us; business or trade losses.
5.4. Our entire liability in connection with training services will not exceed the purchase price of the services booked less any amendment charges paid to us.
5.5. except in relation to death or personal injury caused by our negligence our liability remains, at all times, limited to the value of the services booked, excluding any amendment charges paid to us.
7/ Behavior
By purchasing from BKS Training you are agreeing to co-operate in a professional and adult manner If at any point your behaviour is considered unacceptable, causes damage to the course/environment or distracts other learners, your course may be terminated instantly and you will asked to leave the premises.
The information you provided to us in the form of application details will be kept pending further enquiry and maybe passed onto the relevant authorities if serious enough.
No full or part refund will be given if you are evicted off the course.
8/ Results
Exam papers are marked by an external Awarding Body and will be available 14 working days after the final day of your course. Delays maybe unavoidable circumstantial to the Awarding Body and other un-controllable factors.
If you fail your course, it is up to you to contact BKS Training to organise an appropriate time for you to attend a re-sit. BKS Training does not charge for re-sits on all Security Related Exams. If you attend a venue to re-sit an exam without prior notification, you will not be allowed to retake the examination, and you must provide all documentations you supplied on the first day of your initial course
9/Data Protection / GDPR
BKS Training will store the information provided by you, or that is supplied to BKS Training in the interest of carrying out our services to you, in a safe and secure manner in accordance with the Data Protection Act. At no time will BKS Training distribute personal information outside BKS Training without prior acceptance from yourself.
10/Governing Law and Jurisdiction
The contract is subject to English law and the exclusive jurisdiction of the English Courts.
11/Amendments to the Terms
11.1 We reserve the right to amend these Terms from time to time.
The new terms will be effective as soon as they are update on this page of the website; it is recommended that you visit this page when you visit the website to stay up to date with our terms. Continuation of using this website shows acceptance to these terms.
12/Quality of the services
BKS Training will use reasonable skill and care in providing the services to you. We will do so according to the qualification content set out in the agreement and follow the guidelines of the courses set out by the Awarding Bodies. We do not make any commitment to you that the content of the services will meet any specific requirements that you have (unless organised by an external firm to deliver specific training). We expect you to take reasonable care to make sure that the course you have chosen will meet your needs.
We do not make any commitment to you that you will obtain any particular result from your receipt of the services. We do not make any commitment to you that you will obtain any particular qualification from your receipt of the services (unless stated otherwise in the course description on the Website subject to your successful achievement of that qualification).
Any persons who attempt to bribe (in any fashion) any of the trainers to complete the examination in for the delegate, or any other questionable activities which would pass the delegate, will result in the delegate being removed from the course, and delegate (and) person offering the bribe will be reported to the correct authorities.
All representations, warranties and/or terms and/or commitments not expressly set out in these Terms (whether implied by law, conduct, and statute or otherwise) are hereby excluded to the maximum extent permissible at law.
13/General
These Terms constitute the entire agreement between us in relation to the provision by us to you of the Services, and they replace and supersede any prior arrangements between us in relation to the Services.
You acknowledge that you are not relying on any statement made by us or any of our representatives with regard to the Services other than those expressly set out in these Terms. Nothing in this Paragraph shall exclude or restrict our liability for fraud or fraudulent misrepresentation.
The agreement between us which is comprised of these Terms and the terms is not intended to be for the benefit of any third party, and shall not be exercisable by any other person under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
These Terms apply to all contracts for the provision of training services to you to the exclusion of any other Terms specified by you or any of our previous Terms.
Failure by BKS Training to enforce these terms does not make them void or does not waiver our right to enforce these terms again in future times
Each of the above and below Terms shall be read and construed independently of each other so that if one or more is held to be invalid for any reason whatsoever, then the remaining Terms shall be valid. Further, if any Term is found to be void, but would be valid if some part of it were deleted, then such Term shall apply with such modification as may be necessary to make it valid and effective.
BKS Training shall not be responsible for any failure to perform our obligations due to circumstances beyond our control.
BKS Training does not represent or warrant that the information on this website will be accurate, reliable, complete or current. BKS Training advises you to verify the accuracy of any information on the website before relying on it.
14/Commission
If at any point, a commission agreement is founded between one and BKS Training, the commission funds will be paid within 7 working days after the course has been taken by the student.
