TERMS AND CONDITIONS
1. INTRODUCTION
1.1 These Terms and Conditions govern the sale and provision of training courses by BKS Training LTD (“we”, “us”, or “our”) to you (“the learner”, “the client”, or “the company”).
1.2 By booking a course with us, you agree to be bound by these Terms and Conditions.
2. BOOKING AND ADMISSION
2.1 Course Places: To guarantee a place on any course, full payment or a pre-arranged deposit must be received prior to the course start date.
2.2 Reservations: Places may be reserved without advance payment; however, these are not guaranteed. If the course is full or study environment limitations apply, unpaid reservations may be turned away. A premium price may apply for payment made on the first day of training.
2.3 English Language Assessment: It is a requirement (including for Security Industry Authority (SIA) courses) that all learners undergo an English assessment before the course commences. Failure to reach the required standard will result in refusal of admission to the course.
2.4 Documentation: Learners must provide valid identification and any other required documentation as specified in the course joining instructions.
3. PRICING AND PAYMENT
3.1 Fees: The price you see is the price you pay; there are no hidden costs. However, we reserve the right to change prices without notice.
3.2 Price Protection: If you have booked and paid (in full or in part) in advance, you will pay the lower of the booking price or the current price if fees change.
3.3 Payment Methods: We accept Cheque (must clear prior to the course), Bank Transfer, card or PayPal via our website.
3.4 Discounted Rates: Any discounted prices offered are strictly subject to full or partial payment being received before the course date.
4. CANCELLATIONS, RESCHEDULING, AND REFUNDS (BY THE LEARNER)
4.1 Notification: If you are unable to attend, you must contact us via phone or email.
4.2 More than 5 Working Days’ Notice: (a) Rescheduling: We will agree upon the nearest suitable rescheduling date within the next 6 months at no extra charge. (b) Refunds: You are entitled to a full refund of monies paid, less reasonable administration costs.
4.3 Less than 5 Working Days’ Notice: (a) No refund will be given, as we are unlikely to resell the course seat. (b) If a corporate/private training booking is cancelled with less than 5 working days’ notice due to reasons outside our control, 50% of the pre-agreed price will be refunded. If no fee was pre-agreed, fees for 6 learners or 50% of total fees (whichever is greater) will be retained by us.
4.4 Non-Attendance: In the event of non-attendance without prior notification, or cancellation on the day of the course, no refund will be given. If payment has not yet been made, the full course fee will become immediately due and payable.
4.5 Insufficient Documentation: If a learner is unable to continue a course due to insufficient documentation, 50% of the course fee will be charged.
5. CANCELLATIONS AND AMENDMENTS (BY BKS TRAINING)
5.1 We reserve the right to change course dates, venues, or content. In the unlikely event of such changes, we will contact you as soon as reasonably possible.
5.2 If we must change or cancel a course, you will be offered the following options: (a) Accepting the new conditions/dates; (b) A full refund of all monies paid; or (c) Transferring to a different course (refunding or paying the difference in price as applicable).
6. CONSUMER CONTRACTS REGULATIONS
6.1 We comply with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you are booking as an individual consumer (not a business), you may have additional cancellation rights within a 14-day cooling-off period, provided the service has not already been fully performed.
7. LIABILITY
7.1 Nothing in these terms limits our liability for death or personal injury caused by our negligence.
7.2 We shall not be liable for any indirect or consequential loss, loss of profit, or loss of business arising out of or in connection with these terms.
8. DATA PROTECTION
8.1 We will process your personal data in accordance with our Privacy Policy and applicable data protection laws.
9. GOVERNING LAW
9.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
